You can find off-market properties through six routes: estate agents with a register of prospective buyers, access-restricted platforms, banks and wealth managers, family offices and investor networks, property managers and advisers, and approaching owners directly. On every route, the same things are decisive: a precise search profile, a verifiable financing framework and fast, reliable responses.
Why can’t you find off-market properties on portals?
By definition, off-market properties are not on public portals. The owner has decided against a listing, usually for reasons of discretion. They or their estate agent therefore approach buyers selectively – buyers they know or whose search profile they have.
This leads to the most important principle: You do not search for the property; the property searches for a buyer it already knows. Your task is to be known in the right places – with a clear profile and demonstrable purchasing power.
What off-market means exactly and how it differs from pre-marketing is explained in the guide What is off-market property?.
Which routes to off-market properties are there?
There are six routes, which differ in effort, reach and type of property. Most successful buyers use several of them at the same time.
| Route | Typical properties | Effort for you | Strength | Weakness |
|---|---|---|---|---|
| Estate agents with a register of prospective buyers | all property types, regional | medium | local market knowledge | each agent covers only a segment |
| Access-restricted platforms | apartment buildings, commercial property, villas | low | many providers in one place | quality depends on the vetting |
| Banks and wealth managers | properties of wealthy clients | low to medium | relationship of trust | usually only for their own clients |
| Family offices, investor networks | larger investment properties, portfolios | high | large volumes | hard to access |
| Property managers, tax advisers, notaries | existing properties, inheritances | medium | informed early | often not allowed to pass anything on |
| Approaching owners directly | specifically selected buildings | high | no competition | low hit rate, legal limits |
How do you use estate agent networks properly?
Estate agents are the most common route to off-market properties. Many offer new mandates to their registered prospective buyers first, before listing – or without any listing at all.
How to become a preferred contact for estate agents:
- Be specific: „Apartment building in southern Leipzig, 8 to 15 units, up to €2.5 million, multiple up to 22“ instead of „investment properties in eastern Germany“.
- Prove purchasing power: Have a financing confirmation or proof of equity ready.
- Respond quickly: React to an anonymous profile within a few days with yes, no or a specific question.
- Stay reliable: Anyone who pulls out after committing will not be asked about the next property.
- Clarify commission early: Ask at the outset whether a buyer’s commission is payable and how much – not only once the exposé is on the table.
One disadvantage: each estate agent knows only their segment of the market. Anyone searching nationwide or in several cities has to maintain many contacts.
What do off-market platforms offer?
Off-market platforms bring together properties from many owners and estate agents in one place and show them only to a limited, registered group of buyers. They solve the main problem of agent networks: fragmentation.
When choosing a platform, look at:
- Who runs it? Legal notice, registered office, licence under § 34c Trade Regulation Act (GewO) for estate agency activity.
- How are properties checked? Does every property come with the owner’s mandate?
- How is discretion ensured? Staged release, confidentiality agreement, logging.
- What does it cost? Fees, commission, subscription.
How diskret.immo works: You describe your search in your own words, for example „mixed-use building in Potsdam up to €3 million“. The search in your own words translates the input into criteria according to fixed rules, matches it against all anonymous profiles and shows each one with a match score from 0 to 100 and a short explanation. Saved as a search profile, you receive an email when new matching anonymous profiles appear (without address), and your demand becomes visible to owners – only as a number, and only once there are three or more matching profiles. You can request the exposé as soon as our team has activated your account as vetted; exposé and address are released in stages and only with the owner’s consent. More under Buy off-market property.
For buyers, using diskret.immo is free of charge: the buyer account, anonymous profiles and search profile cost nothing. The buyer’s commission is stated in every anonymous profile.
How do banks, family offices and advisers help?
Banks, wealth managers and family offices often learn early that a client wants to sell – for example during succession planning or when restructuring assets. They then prefer to place the property with buyers they know themselves.
- Banks: Private banking departments occasionally bring clients together. This usually requires an existing client relationship.
- Family offices: They buy and sell themselves and exchange properties among each other. Access is through personal recommendations and investor rounds.
- Tax advisers, notaries, property managers: They know about sale intentions early but are bound to confidentiality. They can pass your interest on to their clients, not the other way round.
Is it permitted to approach owners directly?
Yes, within limits. Anyone approaching owners directly first needs a way to reach them – and in Germany the land register (Grundbuch) does not readily provide one: access is only granted to those who demonstrate a legitimate interest (§ 12 Land Register Code, GBO). A mere interest in buying is generally not enough.
Common routes are therefore:
- A letter to the building’s address or via the property management („to the owner“)
- A personal recommendation from your own network
- Local presence: Anyone who is known in a neighbourhood hears about sale intentions
In Germany, investors, companies and estate agents need the recipient’s prior express consent for advertising by email, and likewise for calls to private individuals; for calls to businesses, presumed consent is sufficient (§ 7(2) Act against Unfair Competition, UWG). A purchase enquiry also counts as advertising. Private buyers are not bound by competition law, but unwanted emails or calls can also give rise to injunctive claims against them under §§ 823, 1004 German Civil Code (BGB). Anyone writing to owners by name must also comply with the GDPR (DSGVO), for example by informing them of the source of the address (Art. 14 GDPR). The hit rate of direct approaches is low and the effort high. It is mainly worthwhile if you have a very specific building or street in mind.
Note: This guide provides a general overview and is no substitute for legal advice. Have letters to owners and advertising measures checked beforehand.
How do you write a search profile that is taken seriously?
A good search profile is so precise that a provider can decide in seconds whether their property fits. Vague profiles end up at the bottom of the list because they require follow-up questions.
| Item | Too vague | Good |
|---|---|---|
| Region | „Eastern Germany“ | „Leipzig, city area and immediate commuter belt“ |
| Property type | „Investment property“ | „Apartment building, without or with little commercial space“ |
| Size | „Medium-sized“ | „8 to 20 units, 600 to 1,500 m² living space“ |
| Price | „Depends on the property“ | „Up to €3 million, financing confirmation available“ |
| Yield | „Good yield“ | „Gross yield from 4.5%, i.e. multiple up to 22“ |
| Condition | „Doesn’t matter“ | „Existing building in need of renovation possible, no listed building“ |
| Timing | „At some point“ | „Purchase within the next 6 months“ |
On diskret.immo, you write the profile as one sentence into the search in your own words. It shows the recognised criteria as building blocks that you can refine before saving. Several strategies – for example an investment apartment building in Berlin and commercial property in the Frankfurt area – are better set up as separate profiles.
How do you recognise dubious off-market offers?
Under the „off-market“ label, offers also circulate that are not genuine: exposés passed on without the owner’s mandate, properties that were sold long ago, or prices that do not match the rents. Warning signs are:
- The provider cannot say on whose behalf they are acting.
- You receive the address and photos without any confidentiality agreement.
- The same property is offered to you by several sides.
- There are key figures but no documents.
- You are asked to pay a commission or reservation fee before seeing the documents.
- Time pressure is built up („commit today“).
If the same property is offered to you by two estate agents, a dispute over commission may arise later. Clarify early who first pointed you to the property.
Checklist: How to prepare as an off-market buyer
With this list, you are ready when the right property turns up:
- Set out your search profile in writing: region, property type, price range, minimum and maximum size, target yield or purchase price multiple, exclusion criteria.
- Clarify financing: Obtain a financing confirmation from the bank or proof of equity (proof of funds).
- Decide on the purchasing entity: Private individual, GmbH or another company – decide with your tax adviser before making an offer.
- Have identification documents ready: ID and, for companies, an extract from the commercial register and details of the beneficial owners (Anti-Money Laundering Act).
- Have a review team ready: Tax advice, legal advice, building surveyors for the due diligence.
- Read the confidentiality agreement in advance: Know what you are signing (NDA).
- Set response times: Reply to anonymous profiles within a few days and to exposés within one to two weeks with a clear statement.
- Combine channels: Two to three regional estate agents, one platform, your network – and maintain every contact.
- Prepare a letter of intent: A template for an LOI speeds up negotiations.
How can I access off-market properties as a private individual?
Through the same routes as professionals: estate agents with a register of prospective buyers, access-restricted platforms and your own network. A precise search profile and proof of funds are important – they make you be perceived as a serious buyer.
Do I have to pay more commission for off-market properties?
Not necessarily. In Germany, for apartment buildings, commercial property and plots, the commission is freely negotiable. If a consumer buys an apartment or a single-family house, the following applies: if the estate agent works for both sides, both pay the same amount (§ 656c BGB); if they work only for the seller, the buyer may take on at most half, and only after the seller has paid (§ 656d BGB). At diskret.immo, the amount is stated in the anonymous profile.
How long does it take to find a suitable off-market property?
That depends on how narrow your profile is and how sought-after the region. There are no generally valid figures. The more precise your profile and the more suitable channels you use, the sooner you hear about properties.
May I contact owners by email?
Anyone acting commercially – investors, companies, estate agents – only with prior express consent, because a purchase enquiry also counts as advertising (§ 7(2) no. 2 UWG). Private buyers do not fall under the UWG, but risk injunctive claims under §§ 823, 1004 BGB for unwanted emails. A letter is permitted as long as the recipient has not recognisably objected, for example with a „no advertising“ sticker or an earlier refusal.
Can I inspect the land register to find owners?
As a rule, no. In Germany, access requires a legitimate interest (§ 12 GBO); a pure interest in buying is usually not sufficient.
